SHEBAH USER TERMS

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

CONTRACTUAL RELATIONSHIP

Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you, the Account holder, and Shebah. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you.

Shebah may restrict you from accessing or using the Services, or any part of them, immediately, without notice, in circumstances where Shebah reasonably suspects that:

  • You or your dependents have, or are likely to, breach these Terms; and/or

  • you or your dependents do not, or are likely not to, qualify, under applicable law or the standards and policies of Shebah, to access and use the Services.
     

Shebah may terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof:

  • immediately, where Shebah reasonably suspects that:

    • you or your dependents have, or are likely to, materially breach these Terms; and/or

    • You or your dependents do not, or are likely not to, qualify, under applicable law or the standards and policies of Shebah, to access and use the Services; or

  • on 30 days' written notice to you, where Shebah, acting reasonably, terminates these Terms or any Services for any legitimate business, legal or regulatory reason.
     

Without limiting its other rights under these Terms, Shebah may immediately restrict or deactivate your access to the Services if you breach these Terms or Shebah service policies at any time.

You may terminate these Terms at any time, for any reason.

Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services.

Shebah may amend the Terms, any policies or supplemental terms related to the Services from time to time. Shebah will provide you with at least 30 days' written notice in the event of a material change to any Terms, policies or supplemental terms that detrimentally affects your rights under these Terms. Amendments will be effective upon Shebah’s posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting, or after the expiry of the notice period (whichever is later), constitutes your consent to be bound by the Terms, as amended.

Our collection and use of personal information in connection with the Services is as provided in Shebah’s Privacy Policy. Shebah may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include an accident, involving you and a Third Party Provider (including a transportation network company driver) and such information or data is necessary to resolve the complaint, dispute or conflict.

THE SHEBAH SERVICE

These Terms govern the supply within Australia by Shebah Pty Ltd (ACN (Shebah) to you of transportation arrangement and related services (the Service).

Your use of the Service constitutes your agreement that you and any other passengers for whom you arrange transport are bound by these Terms.  If you do not agree, you may not use the Service. Shebah may amend or terminate these Terms or the Service at any time and for any reason.

Shebah is not a transportation carrier, and does not provide transportation services.  All transportation services are provided by independent contractors (Third Party Providers), who are not agents of or employed by Shebah.

The Service is a technology platform that enables users of Shebah’s App, through mobile devices or on its website, to arrange transportation services with Third Party Providers, and includes related services such as use of the website, payment facilitation, associated content and other products Shebah makes available to users.

YOUR RIGHTS

Privacy – Shebah takes the privacy of Account holders, passengers and Third Party Providers very seriously.  We commit to comply with the Privacy Act 1988 (Cth) and with the Shebah Privacy Policy available on our website.  Purposes for which we collect and may use and disclose your and other passengers’ Personal Information include registering and managing your account and use of the App, providing you with the Service, exercising rights and carrying out obligations under these Terms, and operating the App and the Shebah business in accordance with good business practice.

App Licence – Shebah grants you a limited, non-exclusive, revocable, non-transferrable license to access and use the App and materials we provide solely in connection with your use of the Service, and in accordance with these Terms.  You may not without Shebah’s permission: modify or copy the App or Shebah materials; use the App or materials for any commercial purpose or public display; attempt to decompile or reverse engineer any software contained on the App; or replicate the App or materials on a server.

Consumer guarantees – we provide the Service subject to consumer guarantees under the Competition and Consumer Act 2010 (Cth).  Nothing in these Terms affects your statutory rights. We make no express warranties beyond these consumer guarantees.  To the extent permitted by law, our total liability for any loss or damage that you suffer or incur from using the Service is limited to us re-supplying the Service to you or refunding the Charges you have paid us for the Service to which your claim relates.

Disputes  – you may raise a dispute with Shebah about any aspect of the Service or transportation arranged through the Service, by following the process on the App.

USE OF THE SERVICE

User Accounts – In order to use the Service you must register for and maintain an active personal user Service account (Account). The holder of the account is the owner of the valid credit card entered into the Account (Account holder). You may only obtain an Account if you are:

  • Female 18+ years; 

  • Male 18+ years who must ride with a child in need of a child seat; or

  • Female under 18 years of age who is a dependent of an Account holder;
     

Or you intend for the Service only to be used for bookings you make on behalf of a female dependent. 

You may not authorise non-dependent third parties to use your Account. You may not transfer your Account to any other person or entity.  An invalid or expired payment method on your Account may prevent you using the Service.

Passenger Requirements and Conduct –  you may only use the Service to arrange transport for yourself and other passengers who are: 

  • Adult females; 

  • Children under the age of 18 accompanied by an adult female;

  • Children in need of child seats accompanied by an adult male;

  • Unaccompanied female dependents of the Account holder under the age of 18; and

  • Unaccompanied male dependents of the Account holder under the age of 13 until 5pm. 
     

You must not invite or allow any person outside those categories to be a passenger.  If there is no adult passenger, the Third Party Provider must have a contact phone number of the Account holder, and you must be contactable at all times during the transportation. In all cases, the Account holder is liable to pay all charges.

Any passenger may be asked to provide proof of age or identity to access or use the Service or transport arranged through the Service, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity or other method of identity verification.

You and your dependents/passengers must comply with applicable laws when using the Service and in the course of transport, and must not cause nuisance, annoyance, inconvenience, or property damage to a Third Party Provider. 

 

Shebah Advanced Booking Service - Shebah offers an extension on the Shebah Service which is titled “Advanced Bookings”. Advanced Bookings gives Shebah riders the opportunity to book their trip in advance. The advanced bookings service means Shebah riders can book their trip anywhere from 90 minutes to 14 days in advance at the time of their choosing. Using the advanced booking feature means the rider will encour an additional $2.00AUD fee. A cancellation fee of $19.16 applies if an Advanced Bookings trip is cancelled within 1 hour of an advance booking. This is to cover the driver’s time and petrol spent heading to you.   

 

Shebah Drop Service - Shebah offers an extension on the Shebah Service which is titled “Shebah Drops.” Shebah Drops is the option for users of the Shebah Service to request a driver to pick up an item(s) or supplies on the behalf of the user and deliver the item to the drop-off location for a flat rate of the minimum fare amount. The minimum fare amount varies from state to state starting at $11.66 ($11.00 as the base level charge and an additional $0.66 transaction fee) and may increase with other optional charges such as but not limited to: 

  • Advanced Booking Feature - $2.00 charge direct to Shebah Pty Ltd

  • Preferred Driver Feature - $1.00 charge direct to Shebah Pty Ltd 

  • Tolls 

 

Users of the Shebah Drops extended service must: 

  • Hold an active Shebah account

  • Be the owner of said account 

  • Be 18+ 

 

In the event that a male passenger orders an item(s) to be dropped using the Shebah Drops service, the driver has the right to refuse that request.

 

Upon accepting the trip, Shebah Drivers will be required to take a photograph of the item(s) precured on behalf of the user and send said photograph to the user as proof of pick up. Drivers are also required to take a photograph of the item(s) precured on behalf of the user and send said photograph to the user at the point of drop-off as proof of drop-off. Shebah is not liable for incorrect, damaged or lost/stolen item(s). 

 

Shebah Ptd Lty and the Shebah Driver is not responsible or liable for item(s) delivered via the Shebah Drops service in any case. Users using the Shebah Drops service do so at their own risk. 

Shebah Split Fare Service.

 

These terms and conditions exist in addition to the Shebah terms and conditions. Shebah’s terms and conditions govern all rides or ride requests.

 

To split a fare a rider must book an eligible ride. The split fare function must be carried out before the ride is complete or the fare will be fully deducted from the lead rider account. An Eligible Ride means a ride using the Shebah mobile application for riders (Shebah App’) requesting an advance booking or instant ride. All rides will be equally split between the number of riders the eligible ride has been shared with via the Shebah Rider App. Lead riders can split the fare with up to 3 Additional riders, splitting the cost of the trip up to 4 equal ways.

 

Lead rider is the Shebah rider who is the first person to book the Shebah ride. Additional riders are those whom the lead ride decides to share the ride with.

 

All riders must have a Shebah Rider account to utilize the split fare function. When the lead rider books a Shebah, the App will place a hold on the estimated fare cost to their account. In a circumstance where additional riders account balance do not exist, the lead rider will be charged the full amount of the trip.  

Device and network usage – Shebah does not guarantee that the Service will function on any particular hardware or devices. The Service relies on your device and its network access and may be subject to limitations and delays inherent in the use of devices and electronic communications. HERE Maps functions (for example the speed notification function or the use of maps in general) are reliant on network access and location services and may be subject to limitations or delays depending on the use of device or network. Your mobile network’s data and messaging fees apply.

Breach and termination – If you use or attempt to use the Service in breach of any Term, Shebah may charge you a cancellation or breach charge as notified on the App or website, and may terminate your Account.

Text Messaging – By creating an Account, you agree that the Services may send you text (SMS) messages as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) messages from Shebah at any time by following the directions and/or prompts within the SMS. You acknowledge that opting out of receiving text (SMS) messages may impact your use of the Services.

Promotional Codes – Shebah may, in Shebah’s sole discretion, create promotional codes that may be redeemed for Account credit, or other features or benefits related to the Services and/or a Third Party Provider’s services, subject to any additional terms that Shebah establishes on a per promotional code basis (“Coupons”). You agree that Coupons: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by Shebah; (iii) may be disabled by Shebah at any time for any reason without liability to Shebah; (iv) may only be used pursuant to the specific terms that Shebah establishes for such a Coupon; (v) are not valid for cash; and (vi) may expire prior to your use. Shebah reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Coupons by you or any other user in the event that Shebah reasonably determines or believes that the use or redemption of the Coupon was in error, fraudulent, illegal, or in violation of the applicable Coupon terms or these Terms.

User Provided Content – Shebah may, in Shebah’s sole discretion, permit you from time to time to submit, upload, publish or otherwise make available to Shebah through the Services textual, audio, and/or visual content and information, including commentary and feedback related to the Services, initiation of support requests, and submission of entries for competitions and promotions ("User Content"). Any User Content provided by you remains your property. However, by providing User Content to Shebah, you grant Shebah a worldwide, perpetual, irrevocable, transferable, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works of, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Services and Shebah’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents and releases necessary to grant Shebah the license to the User Content as set forth above; and (ii) neither the User Content nor your submission, uploading, publishing or otherwise making available of such User Content nor Shebah’s use of the User Content as permitted herein will infringe, misappropriate or violate a third party’s intellectual property or proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

You agree to not provide User Content that is defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive, as determined by Shebah in its sole discretion, whether or not such material may be protected by law. Shebah may, but shall not be obligated to, review, monitor, or remove User Content, at Shebah’s sole discretion and at any time and for any reason, without notice to you.

CHARGES AND PAYMENT

Use of the Service will result in charges to you for transportation you arrange with Third Party Providers, as notified to you on the App or at the time of the transportation (Charges). After transportation has been arranged through your use of the Service, Shebah will facilitate your payment of the applicable Charges to the Third Party Provider.  Charges will be inclusive of applicable taxes. Charges paid by you are final and non-refundable, unless otherwise determined by Shebah.

Charges are due at the time you use the Service. Payment will be facilitated by Shebah using a payment method designated in your Account, after which Shebah will send you a receipt by email.  You may cancel your request for transportation from a Third Party Provider at any time prior to the Third Party Provider’s arrival, in which case you may be charged a cancellation fee.  

Other charges, such as for waiting time or failing to use the transportation after the Third Party Provider has arrived, may be notified to you on the App or by the Third Party Provider.  You agree that Shebah may charge all such Charges to your Account without need to notify you or obtain your consent.  

Repair or Cleaning Fees – You shall be responsible for the cost of repair for damage to, or necessary cleaning of, Third Party Provider vehicles and property resulting from use of the Services under your Account in excess of normal "wear and tear" damages and necessary cleaning (“Repair or Cleaning”). In the event that a Third Party Provider reports the need for Repair or Cleaning, and such Repair or Cleaning request is verified by Shebah in Shebah’s reasonable discretion, Shebah reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning on behalf of the Third Party Provider using your payment method designated in your Account. Such amounts will be transferred by Shebah to the applicable Third Party Provider and are non-refundable.

 

Tolls - Passenger fare will include tolls if the trip goes through a toll road.

State Levies - Passenger fares will also include a state levy fee per trip if a trip occurs in a state where Commercial Passenger Vehicle levies are mandatory. ​

Tipping - Upon the conclusion of a Shebah Trip (Ride or Drop) passengers have the option of tipping their driver if they so choose. Passengers will have the option of tipping their driver, $3, $5 or $10, which will be offered to them in a separate screen after they have completed their ride.Passengers also have the option of leaving a comment, positive or negative, for their driver at this point. Passengers will be charged an additional $0.66 transaction fee on top of their tip, meaning passengers will be charged $3.66, $5.66 or $10.66 if they choose to tip. Tipping is a completely voluntary action as is the decision of the passenger who holds the Shebah account. Passengers will also receive a secondary receipt from Shebah via email that details the amount charged to them if they choose to tip. 

 

Drivers receive 100% of the tips they receive from passengers, excluding the additional $0.66 transaction fee riders pay on top of their tip. There is also an additional charge on tips taken by Stripe - Shebah’s third party payment company. Stripe fees are 1.38% plus GST of the amount. Therefore on a $3 tip the driver will receive $2.96. On a $5 tip the driver will receive $4.93 and on a $10 tip the driver will receive $9.85. This stripe charge goes direct to stripe and has nothing to do with Shebah.

 

Shebah is not responsible for passengers who tip accidentally or unintentionally. Shebah is not responsible for unaccompanied minors who tip without parental consent. Tips cannot be refunded to passengers.

Shebah for Workplace - All Shebah for workplace trips incur a $1 administration fee

DISCLAIMERS

No guarantee – Shebah does not warrant or provide any guarantees in relation to the use of the Service, the reliability of information provided to you through the App, nor the availability or functionality of the App.  Shebah has policies as notified on the Shebah website and App designed to promote the provision of quality transportation by Third Party Providers, but Shebah does not guarantee the quality, timeliness or safety of transportation services.  You accept the risks arising out of your use of the Service and in the nature of transportation services to the maximum extent permitted by law.

Limitation of liability – You agree that Shebah is not liable for: delay or inability to provide the Service due to events beyond our control; the operation and maintenance of Third Party Providers’ vehicles; the actions or inactions of Third Party Providers; consequential loss caused by our breach of these Terms that does not arise in the natural and ordinary course of events; or loss which exceeds $2,000 or the consequences associated with drivers exceeding the speed limits in each state despite the speed limit notification feature within HERE Maps.    

Indemnity – you are liable for and agree to indemnify Shebah against all claims, liabilities, penalties, suits and actions, resulting directly or indirectly from: any information that you have provided to us being inaccurate, misleading or incomplete; your or your passenger’s breach of any law; your or your passenger’s breach of these Terms; or a misuse of the Service by you or your passengers.

Governing Law – these Terms are governed by and construed in accordance with the laws of Victoria, Australia and you accept the exclusive jurisdiction of its courts.

 

WEBSITE TERMS AND CONDITIONS OF USE

 

By accessing the website at shebah.com.au, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

1. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Shebah’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

    1. modify or copy the materials;

    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

    3. attempt to decompile or reverse engineer any software contained on Shebah’s website;

    4. remove any copyright or other proprietary notations from the materials; or

    5. transfer the materials to another person or “mirror” the materials on any other server.

  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Shebah at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
     

2. Disclaimer

  1. The materials on Shebah’s website are provided on an ‘as is’ basis. Shebah makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

  2. Further, Shebah does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
     

3. Limitations

In no event shall Shebah or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Shebah’s website, even if Shebah or a Shebah authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

4. Accuracy of materials

The materials appearing on Shebah’s website could include technical, typographical, or photographic errors. Shebah does not warrant that any of the materials on its website are accurate, complete or current. Shebah may make changes to the materials contained on its website at any time without notice. However Shebah does not make any commitment to update the materials.

 

5. Links

Shebah has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Shebah of the site. Use of any such linked website is at the user’s own risk.

 

6. Modifications

Shebah may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

 

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Australia and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

GIFT CARDS

The Gift Card may only be redeemed via the Shebah Rider app and used within Australia where Shebah Rideshare is available. 

You must have an active Shebah account (with a credit card attached) to redeem the Gift Card, and Gift Cards cannot be transferred between Shebah accounts.

Gift Card credit cannot be used with the Split Fare function of the Shebah app. 

Once purchased from Shebah the Gift Card is not refundable and cannot be exchanged for cash.

Gift Cards expire 3 years from the date of purchase. Any remaining credit at the time of expiration will be void and cannot be used as payment or refunded.

If you have an active Gift Card it will be set as your default payment method until the entire amount has been used. If a fare exceeds the account’s Gift Card credit amount the remaining cost will be charged to the credit card associated with the account. 

If a trip cancellation is made by the passenger, the credit card attached to the passengers account will be charged the cancellation fee (not the Gift Card).

Shebah is not responsible for lost, stolen or destroyed Gift Cards. In the event that your Gift Card does not function correctly through no fault of the customer, Shebah will replace the gift card.

The customer may not use a Gift Card in a way that breaches these Terms (or their spirit) or any applicable law or regulations.

If any term of this Agreement is deemed to be invalid, void or for any reason unenforceable, such term shall be deemed severable and will not affect the validity and enforceability of any remaining terms of this Agreement.

Physical Gift Cards are only available for delivery to addresses within Australia. 

Delivery:

  1. Delivery address means: for plastic Gift Cards, the postal address as stated on the Order.

  2. We will not be responsible for any lost or misdirected Gift Cards, including where an incorrect address or email address has been provided to us. Anyone with access to the nominated delivery address who receives the Gift Card(s) will be presumed to be authorised to receive the Gift Card(s) on your behalf. We do not accept liability for any unauthorised acceptance and any consequential unauthorised redemption of a Gift Card.

Recipient: The e-Gift Card will be sent to the recipient email address​ entered on the purchase page. 

Once submitted via the Website, Orders cannot be cancelled unless required by law. We reserve the right to cancel an Order if it is:

  1. Not accepted at the nominated Delivery Address within 30 days of dispatch date; or

  2. Deemed by us to be fraudulent or possibly fraudulent.

SHEBAH RAFFLE 

The following terms and conditions outline the rules and regulations governing participation in the raffle competition Shebah Raffle organised by Shebah, starting on March 18, 2024, and concluding on April 18, 2024.The Competition is open to individuals aged 18 years and above at the time of entry. Entry Requirements: Participants must comply with the following entry requirements: Participants must be aged 18 years or older.Each entrant must submit their entry via the designated entry method outlined by the organiser. Unlimited entry per person is permitted. Entries received after the stipulated deadline will not be considered. Prize Categories: The Competition comprises multiple prize categories, each featuring one winner selected at random.Selection of Winners: Winners will be chosen randomly from the pool of eligible entries. The draw will be conducted fairly and transparently by the Organiser or their appointed representative. Notification of Winners: Winners will be notified via the contact information provided at the time of entry within seven (7) days following the conclusion of the Competition. Winners must respond to the notification within fourteen (14) days to claim their prize. Failure to respond within this timeframe may result in disqualification, and an alternate winner may be selected. Prizes: Prizes awarded are non-transferable and may not be exchanged for cash or alternative rewards. The organiser reserves the right to substitute any prize with another of equivalent value without prior notice. Publicity: By participating in the Competition, entrants consent to the use of their name, likeness, and entry submissions for promotional and marketing purposes related to the Competition, without additional compensation or prior approval. Data Protection: The Organiser will process personal data obtained during the Competition in accordance with applicable data protection laws and regulations. Participant information will be used solely for the purpose of administering the Competition and will not be shared with third parties without consent, except as required by law. Disqualification: The Organiser reserves the right to disqualify any entrant found to be in violation of these terms and conditions or engaged in fraudulent or inappropriate conduct. Amendments and Termination: The Organisation reserves the right to amend or terminate the Competition or these terms and conditions at any time without prior notice. Any changes will be communicated promptly via the Organizer's official channels. Governing Law: The Competition and these terms and conditions shall be governed by and construed in accordance with the law without regard to its conflict of law principles. Acceptance of Terms: Participation in the Competition constitutes acceptance of these terms and conditions in their entirety.
